How it works
First the vacation days are set using the article 76 LFT table: 12 days in the first year, 14 in the second, 16 in the third, 18 in the fourth, and 20 in the fifth; from the sixth year onward, two more days are added for every five years worked (22 days for years 6 to 10, 24 for years 11 to 15, and so on). Then the daily salary is found by dividing the monthly salary by 30. Vacation pay is the daily salary times the corresponding days, and the vacation premium is that pay times the percentage (the legal minimum is 25%). For example, with a monthly salary of $12,000 and 3 years of service: you are entitled to 16 days, the daily salary is $400, vacation pay is $6,400, and the 25% premium is $1,600, for a total of $8,000.

- What is the vacation premium (prima vacacional)?
- It is an additional payment equal to at least 25% of the salary for the vacation days (article 80 of the LFT). Its purpose is to let you enjoy your vacation with extra income. The employer may pay a higher percentage, but never less than 25%.
- How is vacation pay calculated?
- The daily salary is found by dividing the monthly salary by 30, then multiplied by the vacation days you are entitled to based on your seniority. For example, with $12,000 a month and 16 days, the pay is ($12,000 / 30) × 16 = $6,400.
- Is the premium paid on all the days?
- Yes. The 25% premium (or the agreed percentage) is calculated on the total pay for your vacation days. With 16 days and pay of $6,400, the 25% premium is $1,600.
- Did the 2023 reform raise the vacation premium?
- No. The 2023 "dignified vacation" reform increased the vacation days (from 6 to 12 in the first year), but the vacation premium is still a minimum of 25%. Because it is a percentage of the vacation pay, more days means a higher premium in pesos too.
